Terms and Conditions
By entering into a contract with Terrassement Euro Inc. (“we,” “us,” or “our”), the Client (“Client”) acknowledges and agrees to abide by these Terms and conditions (“Terms”).
Agreement and Deposit Terms
By signing the estimate, the Client agrees to enter into a contract with us and accepts the Terms and Conditions outlined in this agreement. To reserve our services, the Client must provide a non-refundable deposit of 10% of the total estimate. This deposit will not be refunded if the Client cancels the contract or if we must cancel due to unprofessional behaviour.
While we will make every effort to adhere to the proposed timelines, they are not guaranteed due to unforeseen circumstances, such as weather conditions, material shortages, or other external factors beyond our control. All project details have been thoroughly explained and accepted by the Client prior to signing the contract.
Liability Insurance and Property Boundaries
The client is responsible for ensuring that property boundaries are properly identified to avoid encroaching on a third party’s property. The client is also responsible for obtaining the necessary permits from their municipality for any required work. We commit to complying with the terms of this contract, regulations, and best practices. We are responsible for cleaning the property
and removing all debris after completing the services. We confirm holding a certificate of liability insurance. Permit fees for occupying public land will be obtained by us, sent and billed separately to the client after the completion of the work.
Payment Terms
Full payment is due upon completion of the work. Any unpaid amount will automatically accrue late payment interest at a rate of 10% of the total amount as a recovery fee.
Guarantee and Maintenance Procedures
Each project carried out by our team has a guarantee. However, the guarantee will only apply once all payments have been made and the required maintenance procedures, as outlined in the owner’s guide, directives, and/or maintenance procedures, have been followed. The warranty does not cover oxidation stains, cracks caused by tree roots, drying of the soil, or damage caused by harsh freezing/thawing winters.
Unforeseen Circumstances
If, during the excavation process, unusual products such as oversized rock, large quantities of concrete, or more than one layer of asphalt are encountered, the additional time required for machinery will be at the customer’s expense.
Limitations of Guarantee
No guarantee is provided on polymer sand, grass, or planting unless indicated otherwise and provided that all maintenance procedures and winterization have been respected.
Photography Consent
The Client grants permission to photograph the project site before, during, and after the work for promotional and documentation purposes.
Contract Cancellation due to Disrespectful Behavior
We expect all Clients to maintain a respectful and professional demeanour when interacting with our personnel, including employees, contractors, and representatives. Respectful conduct entails refraining from any form of verbal, written, or physical abuse, threats, harassment, discrimination, or any other behaviour that may cause harm, distress, or discomfort to our personnel.
In the event that the Client engages in disrespectful behaviour towards our personnel, despite receiving a warning, we reserve the right to cancel the contract with immediate effect. Upon contract cancellation, the Client will be responsible for any outstanding fees or costs incurred up until the date of termination.
Confidentiality and Data Protection
The Parties agree to comply with the provisions of Loi 25, which governs the protection of personal information in the private sector. Each Party shall take all necessary measures to ensure the confidentiality, integrity, and security of personal information collected, used, or disclosed under this agreement. The Parties agree to promptly notify each other of any breach of personal
information and to cooperate to mitigate the potential consequences of such a breach.
The client consents to the collection and retention of their personal data for the purpose of providing an adequate, professional, and conscientious service. At any time, the client may access their file or obtain a copy, and may request a correction or withdraw their consent regarding the retention of their personal data. The client’s file is retained for five years from the date of the last
update or insertion in the file, in accordance with the law. At the end of this period, the file will be destroyed in a manner that ensures the confidentiality of the information.
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. The unenforceable or invalid provision shall be interpreted to the maximum extent possible to achieve the intent of the original provision.
Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with applicable law. Any disputes arising from or related to these
Terms shall be subject to the exclusive jurisdiction of the courts.
